Questions (PRESIDENTIAL DECREE NO. 1325)

PD No. 1325 creates a new barangay—Barangay Merville—in the Municipality of Parañaque, Metro Manila, by detaching specified subdivisions from the mother barangay (Barangay La Huerta).

The subdivisions known as Admiral Village and Merville in Barangay La Huerta were detached and separated to form Barangay Merville.

No. Section 1 expressly states that the creation of Barangay Merville does not affect in any manner the legal existence of Barangay La Huerta.

Section 2 provides that, except as otherwise stated in the decree, all provisions of law applicable to regular barangays shall apply to Barangay Merville.

Section 3 states that the present elective barangay officials of Barangay La Huerta shall continue performing their duties in the newly created Barangay Merville until barangay officials are appointed by the President.

Appointed officials will hold office until their successors are elected in the regular barangay elections following the issuance of the decree and shall have qualified.

They hold office until their successors are elected and qualified, unless sooner removed at the pleasure of the President.

The transfer is to be made by the President upon the recommendation of the Commission on Audit.

Section 4 provides that upon effectivity of the decree, the proportionate share of Barangay Merville in the obligations, funds, assets, and other property of Barangay La Huerta shall be transferred by the President upon Commission on Audit recommendation.

Section 5 repeals or modifies all laws or parts of laws and all executive orders or regulations inconsistent with the decree.

Section 6 states that it shall take effect immediately.

The decree states it is issued by the President by virtue of the powers vested by the Constitution.

It emphasizes faster socio-economic development through administrative efficiency, closer supervision of local developmental programs, and the clamor of residents with conformity of local elective officials.

Section 3 states that necessary appointive officers and employees shall be appointed as provided for under existing laws.

It indicates they may be removed at the pleasure of the President, even before their successors are elected and qualified.

The mother barangay is Barangay La Huerta. Portions of it are detached to form Barangay Merville, without affecting La Huerta’s legal existence.
