PD No. 824 created a public corporation known as the Metropolitan Manila. It is administered by a Commission created under the decree.
It covers the cities of Manila, Quezon, Pasay, and Caloocan, and the municipalities of Makati, Mandaluyong, San Juan, Las Piñas, Malabon, Navotas, Pasig, Pateros, Parañaque, Marikina, Muntinlupa, Taguig, and Valenzuela.
It is composed of a Chairman/Governor, Vice-Chairman/Vice-Governor, and three Commissioners/Board Members (for planning, finance, and operations). They are appointed by the President and hold office at his pleasure.
Chairman/Governor: ₱60,000.00 per annum; Vice-Chairman/Vice-Governor: ₱50,000.00 per annum; each of the three Commissioners: ₱45,000.00 per annum.
Heads of departments and subordinate personnel are appointed by the Chairman/Governor; their compensation is fixed by the Commission. All positions except highly professional/technical personnel are subject to Civil Service Law, rules, and regulations.
Non-presidential appointees enjoy security of tenure and may be removed or disciplined only for cause, in accordance with Civil Service Law, rules, and regulations.
The Chairman/Governor serves as the General Manager of the Commission, while the Vice-Chairman/Vice-Governor serves as the Deputy General Manager.
Examples include: (1) acting as a central government to establish/administer programs and services common to the area; (2) levying and collecting taxes and special assessments, borrowing, and issuing bonds/obligations; (3) charging and collecting fees for use of public service facilities; (4) appropriating for metropolitan government operations and reviewing local appropriations with authority to disapprove if inconsistent with Commission policies; (5) reviewing/amending/repealing ordinances and acts of cities/municipalities within Metropolitan Manila (also includes enacting ordinances with penal sanctions within limits, establishing operation centers, and submitting reports).
Penalties may not exceed a fine of ₱10,000.00 or imprisonment of six years, or both, for a single offense.
It may establish: (1) a fire control operation center to direct city/municipal fire services; (2) a garbage disposal operation center to direct collection and disposal; and (3) a transport and traffic center to direct traffic activities.
Planning formulates long-range plans and operationalizes policy directives through detailed plans/programs and research. Finance determines financial requirements and sources of funds, allocates funds, and performs financial analysis. Operations maintains a monitoring/compliance system to evaluate performance (time schedule/costs) against approved plans/policies.
They continue until otherwise provided, except where inconsistent with the decree. The numbers of existing city and municipal councils become members of the Sangguniang Bayan created for each city/municipality of Metropolitan Manila upon promulgation, and until December 31, 1975.
It includes: (1) as many barangay captains as determined and chosen by the Commission; and (2) a number of representatives from other sectors appointed by the President upon recommendation of the Commission.
They do not collect regular salaries/compensation, except per diems and reasonable allowances on a reimbursement basis in amounts fixed by the Commission.
They may recommend measures to the Commission, but none become effective until after approval by the Commission.
The power to impose taxes and other levies, the power to appropriate money, and the power to pass ordinances/resolutions with penal sanctions are vested exclusively in the Commission.
They implement integration of common/essential/municipal/public services approved by the Commission, furnish required information and assist the Commission in integration, and perform other functions directed by the Commission.
They must close their respective books of accounts for submission to the Commission not later than December 15, 1975; thereafter, their functions and responsibilities are performed/discharged by the Commissioner for Finance.
They are under the direct supervision and control of the President. The President may revoke, amend, or modify any ordinance, resolution, or act of the Commission, the General Manager, and the Commissioners.
