Because the law treats the earlier COMELEC-supervised plebiscite as sufficient to meet the plebiscite requirement for the creation of the barangay under Section 10 of the Local Government Code.
The incumbent elected barangay officials of Barangay Rizal shall continue to hold office until their successors are duly elected and qualified.
All existing public infrastructure and facilities for public use are transferred without cost or compensation to the new barangay and shall be administered by it.
It is pursuant to Section 285 of RA 7160, as amended (Local Government Code of 1991).
That the barangay is recognized for purposes of IRA computation and will receive its share consistent with the Local Government Code provisions.
Fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
