It provides for the coordination of all national intelligence activities of the Government by creating a central coordinating agency for intelligence gathering.
A National Intelligence Coordinating Agency (NICA) was created to operate directly under the Office of the President.
The NICA is responsible and accountable only to the President of the Philippines.
It coordinates all government activities related to national intelligence and prepares intelligence estimates and summaries of local and foreign situations for the President and his policy-making body.
A President-appointed Coordinator of National Intelligence heads the NICA.
The President appoints the Coordinator of National Intelligence and receives intelligence estimates/summaries and updates through the Coordinator.
An Intelligence Consultative Committee is established to advise the Coordinator on objectives of national intelligence, allocation of collection responsibilities, and establishing effective working relations among intelligence agencies.
The Committee consists of: (1) Coordinator of National Intelligence (Chairman); (2) Chief, Military Intelligence Service, AFP; (3) Chief, G-2, Philippine Constabulary; (4) Director, National Bureau of Investigation; (5) a representative of the Department of Foreign Affairs; (6) Chief, Confidential Agents, Office of the President; and (7) other agency representatives may be invited when relevant.
It advises on (A) general objectives of national intelligence; (B) allocation of collection responsibilities to various agencies; and (C) means of establishing and maintaining effective working relations between NICA and other intelligence agencies.
The Coordinator of National Intelligence must keep the President advised of the findings of the Intelligence Consultative Committee.
The Coordinator may call upon any department, bureau, office, agency, or instrumentality of the government for information and assistance needed to perform functions.
The Coordinator may request the detail to NICA of trained and qualified personnel from specified departments (Foreign Affairs, Interior, Justice, National Defense, Finance, Labor, or other departments/branches/subdivisions of the national government) deemed necessary for efficient operation.
It supersedes Executive Order No. 167, series of 1948.
It takes effect immediately.
It indicates the agency is placed within the direct control/oversight of the President’s office rather than under a separate department, reinforcing that it is accountable only to the President.
Through NICA’s coordinating role, the consultative committee’s guidance on allocation and working relations, and the Coordinator’s power to call upon agencies and request personnel details to ensure effective collaboration.
