Republic Act No. 9403. The converted state university is known as the Bataan Peninsula State University (BPSU).
The Bataan Polytechnic State College (including its integrated campuses: Bataan Community Colleges in Balanga City and Bataan National School for Filipino Craftsmen in Orani, Bataan) plus the Bataan State College in Dinalupihan, Bataan were integrated into the BPSU.
The main campus is in the City of Balanga.
To primarily provide advanced instruction and professional training in education, engineering, science and technology, arts and humanities, computer and forestry, and other relevant fields; and to undertake research, extension services, and production activities supporting the socioeconomic development of Bataan and provide leadership in its areas of specialization.
It shall offer undergraduate and graduate courses in education, engineering, science and technology, arts and humanities, computer and forestry, and other degree courses within its areas of specialization and according to its capabilities, as determined by the Board of Regents, to meet needs of Bataan and Region III.
Existing high schools shall be transferred to the jurisdiction and supervision of the Department of Education (DepEd). They may remain and operate within the university campus until the current students complete high school. The university may operate a reasonably-sized laboratory school if it has a College of Education.
Administration and the exercise of corporate powers are vested exclusively in the Board of Regents and the president of the University.
The chairperson of CHED (chair); university president (vice chair); Senate Committee on Education chair; House Committee on Higher and Technical Education chair; NEDA regional director; DOST regional director; federation of faculty associations president; federation of student councils president; federation of alumni associations president; and two prominent private sector citizens from the Province of Bataan.
The Board appoints them from a list of at least five persons qualified in Bataan, recommended by a search committee constituted by the University president in consultation with the CHED chairperson and other Board members, based on normal standards and qualifications.
It shall convene at least once every quarter. Special meetings may be called by the chairperson with three days’ prior written notice (maximum of two). Quorum is majority of all Board members holding office at the time, but the chairperson of the Board or the university president must be present.
The Board fixes tuition fees and necessary school charges after due consultation. Fees and charges, including government subsidies and other income generated by the University, constitute special trust funds deposited in an authorized government depository bank; interest forms part of the same funds.
Income generated by the University from tuition fees and other charges, as well as from auxiliary services and land grants, shall be retained by the University and may be disbursed by the Board for instruction, research, extension, or other University programs, provided fiduciary fees are disbursed for the specific purposes they are collected.
The president is appointed by the Board subject to the Board’s guidelines and after recommendation of a duly constituted search committee. The term is four years and eligible for reappointment for another term. The incumbent president of the Bataan Polytechnic State College, if qualified, shall serve as the first president to ensure smooth transition.
The Board designates an officer-in-charge within six months from the date of vacancy pending appointment of a new president. The officer-in-charge (or successor) holds office only for the unexpired term.
All assets, real and personal, personnel and records of the Bataan Polytechnic State College and its integrated campuses, and the Bataan State College, including liabilities/obligations, are transferred to the University. Positions, rights, and security of tenure of faculty and personnel are respected. Government parcels of land occupied by those schools are declared property of the University and shall be titled under its name; if the University ceases/abolished or land is no longer needed, it reverts to the concerned LGU.
Within 120 days from approval, the University must (1) submit a five-year development plan including program budget to CHED for DBM recommendation, (2) undergo a management audit in cooperation with CHED, and (3) set up its organizational, administrative, and academic structure, including appointment of key officials.
On or before the 15th day of the second month after opening of regular classes each year, the Board must file a detailed report on progress, conditions, and needs of the University with the Office of the President of the Philippines through the chairperson of CHED, and with both Houses of Congress.
