Q&A (DOH DEPARTMENT CIRCULAR NO. 2007-0272)

The circular concerns the regulation of containers and labels of milk products within the scope of Executive Order No. 51, also known as the "Milk Code."

Executive Order No. 51 is referred to as the "Milk Code."

All concerned must strictly comply with sections 25 and 26, Rule VII of DOH Administrative Order 2006-0012 (the Revised Implementing Rules and Regulations of EO 51).

Milk companies are directed to submit new labels of their products to the Product Services Division (PSD) on or before 15 January 2008, ensuring that the necessary warnings mandated by Rule VII are incorporated in the new label.

Old labels shall no longer be permitted for use starting March 2008; non-compliant labels are subject to legal and administrative sanctions.

Sanctions include, but are not limited to, recall of violative products and suspension or revocation of the Certificate of Product Registration (CPR).

The warnings are intended to comply with the Milk Code’s regulations which protect breastfeeding and regulate the marketing of milk products to prevent inappropriate promotion.

The new labels must be submitted to the Product Services Division (PSD) of the Department of Health.

No extension beyond the deadline of 15 January 2008 is allowed for submission of new labels.

The Revised Implementing Rules and Regulations (RIRR) of EO 51 under DOH Administrative Order 2006-0012 govern the implementation.
