The primary policy is to regulate, restrict, or prohibit the importation, manufacture, processing, sale, distribution, use, and disposal of lead and lead compounds to prevent unreasonable risks to health and the environment, and to advance research on toxic chemicals.

Applicants are persons or entities engaged in importation, manufacturing, using, distributing, recycling, and providing services such as Treatment, Storage, and Disposal related to lead and lead compounds.

The CCO regulates, limits, or prohibits the use, manufacture, import, export, transport, processing, storage, possession, and wholesale of lead and lead compounds due to their risks to public health, workplaces, and the environment.

Use of lead and lead compounds is prohibited in packaging for food and drink, fuel additives, water pipes, toys, school supplies, cosmetics, and paints with lead content above 90 ppm beyond specified transition periods.

Products must have labeling conforming to the Globalized Harmonized System (GHS) and include a warning label stating that lead dust is hazardous to children, pregnant women, and the elderly.

Violators are subject to administrative and criminal sanctions as provided under Sections 41 and 43 of DAO 92-29 and DENR Memorandum Circular No. 2005-003, including graduated administrative fines pursuant to RA 6969 and related orders.

The Environmental Management Bureau (EMB) of the Department of Environment and Natural Resources (DENR) is responsible for registration, compliance monitoring, and enforcement.

Paints must not exceed 90 ppm lead content. For architectural, decorative, and household applications, this limit must be met by 2016, and for industrial applications by 2019.

Covered entities include importers, distributors, manufacturers, industrial users, recyclers, and waste service providers involved in transport, treatment, and disposal of lead and lead compounds.

An applicant must submit a duly accomplished Registration Form (Annex A) and provide a Lead and Lead Compounds Management Plan including Safety Data Sheets (SDS) to manage and minimize environmental release.
