Q&A (EXECUTIVE ORDER NO. 833)

The purpose of Executive Order No. 833 is to certify the production of fiberglass insulating materials as a preferred pioneer industry in the Philippines, entitling it to post-operative tariff protection by increasing tariff rates on similar imported products.

The production of fiberglass insulating materials by ACI FIBERGLASS (PHILS.), INC., a Board of Investments (BOI) registered pioneer enterprise, is recognized as a preferred pioneer industry.

It provides post-operative tariff protection by increasing the tariff rates on imported glass wool insulating products similar to those produced locally by ACI FIBERGLASS (PHILS.), INC.

The tariff rate for panels and boards made of mineral wool is an ad valorem rate of 40% during the years 1983 to 1985.

From 1986 onwards, the tariff rate for glass fibre (including wool) is 30% ad valorem as recommended by the order.

Any unwarranted increase in prices of local products benefited by these tariff changes may lead to modification of the post-operative tariff rates, with the Board of Investments representing suitable action with the Tariff Commission under Section 401 of the Tariff and Customs Code.

The Board of Investments (BOI) is directed to make the proper representations to the Tariff Commission for appropriate action.

All prior orders, rules, regulations or parts thereof inconsistent with the provisions of EO No. 833 are repealed.

The new tariff rates became effective on or after January 1, 1983.
