Section 20 of Republic Act No. 180, known as the Revised Election Code, grants the President the authority to call a special election.

The Speaker of the House of Representatives certified that a vacancy existed.

The purpose is to elect a member to fill the unexpired portion of the term for the existing vacancy in the House of Representatives for the first congressional district of Negros Occidental.

The special election was scheduled for Tuesday, November 12, 1963.

It coincided with the general elections for provincial and municipal officials and for eight senators.

The provisions of the Revised Election Code were to be followed insofar as applicable in conducting the special election.

Rufino G. Hechanova was the Executive Secretary who signed the proclamation as by the President.
