Title
CSC Policies on Eligibilities in PNP, Fire, Jail Bureaus
Law
Csc Office Memorandum No. 44, S. 1996
Decision Date
Sep 4, 1996
The Civil Service Commission establishes new eligibility criteria for positions in the Philippine National Police and the Fire and Jail Bureaus, clarifying that only specific examinations qualify for permanent appointments and promotions, while repealing previous inconsistent policies.

Questions (CSC OFFICE MEMORANDUM NO. 44, S. 1996)

To inform the public that the CSC, through CSC Resolution No. 965487 (Aug. 26, 1996), adopted new policies on NAPOLCOM-administered examinations and clarified the appropriate civil service eligibilities for positions in the PNP and the Fire and Jail Bureaus, effective immediately.

CSC Resolution No. 965487 dated August 26, 1996, which repealed MC No. 7, s. 1986.

Those who took and passed NAPOLCOM-administered examinations (prior to or after RA 6975), except for the INP Entrance and Police Officer 3rd Class examinations.

Candidates who pass covered NAPOLCOM examinations (other than the exceptions) cannot be appointed under permanent status based solely on having passed those examinations.

No. Under Item (2), those whose appointments were approved under permanent status based on NAPOLCOM examinations continue to enjoy security of tenure in their present or equivalent positions.

For promotion purposes, they must have the eligibility prescribed by the qualification standards for the positions to which they will be promoted.

They must have passed any of: (a) INP Entrance Examination; (b) Police Officer 3rd Class Examination; or (c) CSC Police Officer Entrance Examination.

No. The resulting eligibilities are appropriate not only for uniformed but also for non-uniformed first level positions in the Fire and Jail Bureaus.

Holders of Career Service Subprofessional eligibility may be considered for temporary appointment to Police Officer I position.

Any of: (a) Career Service (Professional) or its equivalent; (b) PD 907/997; and (c) RA 1080 eligibilities (including PBET).

Both Memorandum Circular No. 17 and CSC Resolution No. 965487 state that the policy takes effect immediately.

Memorandum Circular No. 7, s. 1986; CSC Resolution No. 93-3310; CSC Resolution No. 94-6248; CSC Resolution No. 46, s. 1993; pertinent provisions of CSC Resolution No. 93-4916-A pertaining to Qualification Standards; and all other CSC issuances on eligibility requirements for appointment to the PNP and Fire and Jail Bureaus inconsistent with the resolution.

It cites RA 6975 stating that PNP, Bureau of Fire Protection, and Jail Bureau are under the DILG and thus covered by the Civil Service Law and Rules.

Section 3B of Article IX of the 1987 Constitution, requiring the CSC to establish a career system and adopt measures to promote morale, efficiency, responsiveness and progressiveness in the civil service.

Section 32 of RA 6975 provides that the CSC shall administer the qualifying entrance examination for policemen on the basis of the standards set by NAPOLCOM.

Because there was need for uniform policy and to repeal directives no longer responsive to current developments, ensuring consistent eligibility rules for appointments.
