A

Q&A (DOJ DEPARTMENT ORDER NO. 74)

The primary purpose is to amend certain provisions of the Implementing Rules and Regulations to enhance the implementation of the Witness Protection, Security and Benefit Program, including clarifying the responsibilities and functions of the program implementors.

The Undersecretary in-charge of the National Prosecution Service (NPS) is responsible for the implementation of the Witness Protection Program.

A Program Director assists the Undersecretary in-charge, who upon the Undersecretary's recommendation, is designated by the Secretary.

Key functions include recommending necessary measures for program formulation and administration, examining applicants and verifying compliance, recommending termination of benefits in case of breach, coordinating with government agencies, and performing other legally or secretary-mandated duties.

A substantial breach of the Memorandum of Agreement by the witness triggers the recommendation for termination of rights and benefits.

All references to the "Committee" and/or "Chairman of the Committee" are replaced to mean the "program implementors" and/or "Undersecretary in-charge of the National Prosecution Service."

The amendments become effective fifteen (15) days following their publication in two newspapers of general circulation.

Section 18 of Republic Act No. 6981 (Witness Protection, Security and Benefit Act) authorizes the amendments.

Secretary Franklin M. Drilon signed and adopted the amendments on February 24, 1993.

The Secretary designates the Program Director upon the Undersecretary's recommendation and may from time to time deem necessary policies and duties for effective program implementation.
