The Commission has amended racing rules to enforce a stringent drug testing program, prohibiting the use of performance-enhancing substances in horses, imposing severe penalties for violations, including fines and lifetime bans for repeat offenders.

It further amends the racing rules to prohibit the use of improper devices and PROHIBITED SUBSTANCES or other means that enhance, diminish, or affect a horse’s racing performance.

Any substance that enhances, diminishes, or alters racing performance due to its effects on specified systems (central/peripheral nervous, cardiovascular, respiratory, alimentary digestive, musculo-skeletal, or uro-genital), as identified under Sec. 103-A(d)/references, including but not limited to listed drug categories.

The horse may participate if the owner or trainer informs the racing clubs concerned during the horse’s declaration for participation in an official race.

The stewards may order the club veterinarian to extract blood, saliva, and/or urine from any racehorse for detection of prohibited substances.

The horse is suspended for six (6) months, must undergo rehabilitation during that period, and must undergo a drug test and be certified drug-free before re-entry.

Besides the suspension/penalties above, the prize of the day net of taxes, jockeys’ commission, and trainers’ fund share shall be paid as penalty in favor of the racing clubs for drug testing purposes; in stakes/added prize races, the stakes/added prizes are also paid as penalty.

They are banned from racing for life.

The owner and/or trainer is fined P30,000 each or a total of P60,000 if both are the owner/trainer at the same time (and thus pays full P60,000). Non-payment of the fine causes revocation of owner’s/trainer’s licenses.

The amount corresponding to the fine must be deposited with the racing club together with the challenge fee of P10,000.

At least two (2) horses’ specimens shall be taken after every race—the winner and any other horse(s) selected by the Board of Stewards.

A minimum of six (6) samples shall be tested by the Philracom accredited Laboratory; the Board of Stewards may order testing of other samples at its discretion.

The club must provide a separate, well secured area within the compound, isolated from betting public view, where only the registered owner/trainer or their duly-licensed representative and the groom of the horse may enter.

Two (2) sampling containers per selected horse are taken immediately after the race, sealed and countersigned in the presence of racing club representatives and the owner/trainer (or licensed representative). Failure to be present or to designate an official and licensed representative in writing is treated as waiver of the right to be present.

One sample is retained by the racing club (for use in case of challenge); the other is given to the duly accredited drug testing laboratory for testing, with the retained sample serving as the basis for challenge.

The lab notifies the racing club within fifteen (15) working days after collection if results are positive; the racing club then informs PHILRACOM and the owner/trainer within five (5) working days from receipt.

The retained sample is tested in the Philracom accredited laboratory. The owner/trainer may request presence of NBI and/or DDB chemists. Representatives of the racing club, PHILRACOM, and owner/trainer must be present; failure to be present is deemed waiver.

If positive: the challenge fee of P10,000 is forfeited to the racing club, and the P60,000 deposit is paid as penalty to PHILRACOM. If negative: the owner/trainer is refunded accordingly.
