Q&A (PRESIDENTIAL DECREE NO. 1226)

The main purpose of Presidential Decree No. 1226 is to amend Presidential Decree No. 567 to authorize the President of the Philippines to extend the draft service of draftees beyond eighteen months if deemed necessary for the good of the service.

The initial conscription period for trainees is eighteen months under selective emergency military service.

The President can extend the service if, in his opinion, continued service beyond eighteen months is required for the good of the service.

Any draftee who refuses to render such extended service shall be punished by a Military Tribunal as directed under General Order No. 8.

Within the last six months, draftees not enlisted into the Regular Force shall be given the opportunity to undertake a viable training program to acquire knowledge and skills needed for gainful employment after their service.

Draftees employed for combat operations shall receive the base pay and allowances equivalent to that of a private in the regular force and shall be entitled to all benefits similar to those received by any member of the regular force.

Draftees shall receive a separation gratuity of not less than one month's salary for every year of training and service, with six months considered equivalent to a complete year.

They shall be given priority in appointments in the government service commensurate to their training, experience, and educational qualifications, notwithstanding provisions of the Civil Service Law to the contrary.

They shall be automatically enlisted on the date of death as a private in the Regular Force and separated as private first class with benefits corresponding to that rank.

The decree took effect beginning October 1, 1977.
