The main policy is to devolve, as far as practicable and consistent with the Constitution and RA 6734 as amended by RA 9054, the powers and functions of national government agencies to the Autonomous Regional Government (ARG) of the Autonomous Region in Muslim Mindanao (ARMM).
The provisions specifically apply to the Autonomous Region in Muslim Mindanao (ARMM).
ODA is recognized as one of the sources of funding for programs and projects in ARMM, which can be tapped to hasten the socio-economic development of the region. Programs and projects funded by ODA intended for ARMM shall be implemented by the ARG.
Locally funded programs and projects within ARMM are devolved to and shall be implemented by the Autonomous Regional Government (ARG) of ARMM.
The exceptions are: (a) when Congress provides in the General Appropriations Act or special law which government agency shall implement the program or project, and (b) when the ARMM Regional Governor judges that the ARG lacks the capacity to implement a program or project, in which case the national agency may be requested to implement it.
The devolution provision under Section 1 took effect starting January 1, 2003.
The ARMM component of nationwide ODA programs and projects shall be implemented by the Autonomous Regional Government (ARG) of ARMM.
The ARMM Regional Governor can request a national agency to implement the program or project if the ARG does not have the capacity to do so.
