The main purpose of Executive Order No. 422 is to activate and reorganize the Emergency Petroleum Operations Board as the Energy Operations Board to efficiently and equitably allocate and distribute energy, particularly petroleum products, during severe supply disruptions or imminent dangers.
The Board is composed of the Executive Secretary as Chairman; the Secretary of Trade and Industry; the Secretary of Agriculture; the Secretary of National Defense; the Secretary of Local Government; the Secretary of Transportation and Communications; the Executive Director of the Office of Energy Affairs; and a private sector representative designated by the President.
The Board is responsible for formulating policies, guidelines, and rules for energy allocation and distribution; developing action plans including rationing schemes; consulting with other agencies; and directing other government departments to assist in the allocation and distribution of petroleum products.
The Board shall designate an Executive Director to act as the Executive Officer on a regular and permanent basis. This person heads the Secretariat (Office of Energy Affairs), provides administrative support, and oversees the implementation of the Board’s programs.
The Department of National Defense enforces laws related to prohibited acts under Batas Pambansa Blg. 33, as amended, enforces the Board’s rules and regulations, and provides security and other assistance for effective implementation and enforcement of the allocation and distribution system.
There are Inter-Agency Committees at the regional, provincial, city, municipal, and barangay levels with designated chairpersons and members from relevant departments and private sector representatives. Each committee oversees implementation, monitoring, problem assessment, and remedial actions regarding energy allocation and distribution in their respective areas.
Barangay Councils, led by the Barangay Captains, are responsible for registering all end-users of energy and petroleum products in their areas, overseeing equity in distribution, and reporting violations or shortcomings to higher authorities.
The Metropolitan Manila Authority, together with representatives from all Board members, forms the Metropolitan Manila Inter-Agency Committee headed by its Chairman. It oversees and coordinates energy allocation and distribution in Metro Manila according to the Board’s policies and guidelines.
The Board may call upon other government departments and agencies for assistance and support to successfully implement energy allocation and distribution objectives.
