Case Summary (A.M. No. P-00-1418)
Facts of the Case
On September 7, 1995, Judge Siapno issued a decision in favor of the plaintiff, which mandated an immediate vacating of the premises by Lu and specified the issuance of a writ of execution. Lu's counsel received the decision on September 13, 1995, and filed a notice of appeal on the same day. However, on September 11, 1995, Corpuz issued the writ of execution, and Sheriff Domingo S. Lopez carried out the ejection on that date, prior to Lu's receipt and appeal of the decision.
Administrative Complaints
Lu subsequently filed an administrative complaint against Judge Siapno, Sheriff Lopez, and Private Prosecutor Atty. Joselino A. Viray, leading to concerns about gross incompetence, ignorance of the law, and misconduct. The Court found Judge Siapno and Sheriff Lopez guilty of misconduct and directed the Office of the Court Administrator to file a case against Corpuz for similar charges.
Corpuz's Response and Investigation
In her response, Corpuz denied the allegations, claiming she acted under directives from Judge Siapno, who insisted she issue the writ. The case was referred to Executive Judge Joven F. Costales for an investigation. During this investigation, Corpuz admitted to signing writs of execution under similar circumstances in past cases without prior complaints.
Findings of the Investigating Judge
Investigating Judge Costales noted that Corpuz should have exercised better judgment given her position, which expected her to be familiar with relevant legal rules. His report indicated that she had not adequately addressed the procedural requirements prior to issuing the writ of execution, which led to a finding of gross ignorance of the law.
OCA's Recommendation
The Office of the Court Administrator concurred with Investigating Judge Costales, highlighting that Corpuz's actions displayed irresponsibility and a lack of understanding of proper legal procedure. They recommended a fine of P2,000 for gross ignorance of the Rules of Court and abuse of authority.
Court's Ruling
The Court upheld the findings and recommendations of the OCA and Investigating Judge Costales, finding that Corpuz had issued the writ of execution prematurely. The court emphasized that her actions undermined the integrity of judicial processes and the rights of the parties involved. As a result, she was
