Case Digest (G.R. No. 123979)
Expanded Legal Reasoning Model

Facts:

  • Indictment and Trial
    • Accused-appellants Alipio Santiano, Jose Sandigan, Armenia Pillueta and Jose Vicente “Jovy” Chanco were charged by amended information with kidnapping with murder of Ramon John Dy Kow, Jr., a detainee at Naga City Jail (RTC, Branch 32, Camarines Sur; Criminal Case No. P-2319).
    • They pleaded not guilty and the trial proceeded before the Regional Trial Court.
  • Prosecution’s Version
    • Prior Hostilities:
      • May 13, 1993 – Dy Kow and partner arrested for alleged marijuana possession by Sandigan, Pillueta and other NARCOM agents; detained at NARCOM office and warned not to seek counsel.
      • July 1993 – Santiano, then a fellow inmate, was mauled in jail, allegedly with Dy Kow’s participation; Santiano vowed revenge upon release.
    • December 27, 1993 Abduction and Mauling:
      • About 6:00–7:00 PM – Dy Kow left jail to buy viand; upon exiting the PNP store, was accosted by Sandigan and Santiano, dragged to NARCOM office.
      • Inside NARCOM office – Santiano battered Dy Kow with a handkerchief–wrapped fist for 15 minutes; Pillueta acted as lookout.
      • Chanco parked his trimobile, fetched Dy Kow into the vehicle; Pillueta and Santiano joined.
    • Disappearance and Discovery of the Body:
      • Trimobile proceeded toward Palestina, Pili, Camarines Sur, with Dy Kow aboard.
      • Early December 28 – Dy Kow’s body found in a canal, bearing multiple gunshot wounds; identified by brother Robert Dy Kow and witness RaAola.
  • Defense’s Version
    • Alibis and Alternate Account of Events:
      • Santiano claimed he went to Milaor to fetch a midwife and remained at home from 7:00–10:00 PM.
      • Pillueta, with two SPO3 colleagues, attended Sampaguita Music Lounge from 8:00 PM until 2:00 AM.
      • Sandigan and Chanco alleged social engagements at a burger house and departmental store, then separated.
    • Denial of Victim’s Presence:
      • Defense witnesses asserted Dy Kow was neither seen at NARCOM office nor aboard Chanco’s trimobile on the evening in question.
  • Autopsy Findings
    • External Injuries: contusions on eyelid, laceration on right ear lobule, sub-occipital laceration, puncture on right sternomastoid border.
    • Fatal Wound: gunshot entering right second intercostal space, traversing heart and left lung, lodging in left subscapular area.
    • Cause of Death: internal hemorrhage secondary to gunshot wound.
  • RTC Decision
    • Conviction – All four accused found guilty beyond reasonable doubt of kidnapping under Article 267, RPC; sentenced to reclusion perpetua each and ordered to pay P50,000 civil indemnity to heirs.
    • Acquittal on Murder Charge – Murder allegations not sufficiently proven; penalty for kidnapping alone imposed.

Issues:

  • Whether the amended information was legally sufficient to charge kidnapping with murder.
  • Whether the evidence established the crime of kidnapping under Article 267, RPC.
  • Whether a conviction for one component of a complex crime is permissible when evidence fails to prove the other component.
