Facts:

People of the Philippines v. Alma Garalde y Tan and Kil Patrick Ibero, G.R. No. 128622, December 14, 2000, the Supreme Court En Banc, Per Curiam. The case is an automatic review of the Regional Trial Court (RTC), Branch 79, Quezon City, Joint Judgment dated December 27, 1996 (criminal cases Q-94-58657 and Q-94-58658), which convicted Kil Patrick Ibero of kidnapping for ransom and serious illegal detention as a principal and Alma Tan Garalde as an accomplice; Ibero was sentenced to death and Garalde to reclusion perpetua.

The Informations charged Garalde (with her husband Roque Garalde) in Crim. Case No. Q-94-58657 for illegal possession of firearms (P.D. 1866) and charged Ibero, Garalde, Roque and several John Does in Crim. Case No. Q-94-58658 with kidnapping for ransom and serious illegal detention (Art. 267, Revised Penal Code, as amended by R.A. No. 7659). Only Ibero and Garalde were arraigned and tried; they pleaded not guilty.

The prosecution’s core narrative: on August 9, 1994 three men in a taxi forced their way into a van carrying minors Paolo (13), John (8) and Nino (11) Bellosillo, two yayas (Dianita Bebita, Janidy Dumagpi) and driver Antonio Paquera, blindfolded and spirited the victims away; kidnappers initially demanded P10,000,000, later accepted P410,000 and jewelry; the victims were detained for nine days and released August 18, 1994. The Presidential Anti‑Crime Commission (PACC) traced a blue Toyota Corolla plate TCJ‑185 and a house in BF Resort/Las Piñas and later located the same car at No. 45 Frankville Subdivision, Novaliches; search warrants issued August 19–20, 1994 led to recovery of the Corolla, firearms, ammunition and photos; video of the search was made. Photographs and a police line‑up produced positive identifications of Ibero and Garalde by the kidnap victims; Ibero was arrested August 22, 1994.

At trial the prosecution presented eyewitness testimony from Dianita Bebita and Paolo Bellosillo (among others) who positively identified Ibero as one of the abductors (the man who blindfolded the driver and Paolo) and identified Garalde as the woman who, during captivity, peeped through a door and said, “Itali ninyong mabuti iyan at baka makawala.” The PACC operatives testified to surveillance, tracing of calls, arrests and the search and seizure.

Ibero’s defense: alibi—he claimed to have been at his sister’s house in Paranaque from the night of August 8 through August 9, corroborated by witnesses; he also claimed police suggestion prompted his identification. Garalde’s defense: denial—she denied involvement, claimed two men rented a room in her house unknown to her, recounted being forcibly entered and detained without warrant during the search, and claimed she signed a paper under duress; witnesses for her corroborated ordinary household activity and lack of suspicious comings and goings.

The RTC convicted Ibero and Garalde of kidnapping for ransom and serious illegal detention (Crim. Case No. Q‑94‑58658) on December 27, 1996, acquitted Garalde for illegal possession of firearms (Crim. Case No. Q‑94‑58657), and senten...(Subscriber-Only)
