Case Digest (A.M. No. 99-7-07-SC)

Facts:

  • Oath of Office Requirements
    • Every person appointed as judge must take and subscribe an oath of office before performing any judicial functions.
    • Newly-appointed judges are required to take their oath within ten (10) days from receipt of their appointment notice from the Chief Justice.
    • Judgment on inability: If the appointee is unable to take the oath within the prescribed period, a written explanation must be submitted immediately to the Chief Justice, including when the oath will be taken.
    • Declination of Appointment: An appointee who wishes to decline the appointment must notify the Chief Justice in writing within ten (10) days, stating the reasons for such decision.
  • Orientation Seminar-Workshop
    • Mandatory participants include:
      • New and original appointees to the judiciary.
      • Judges of the first level courts promoted to the Regional Trial Courts who have already taken their oath.
    • Judges given lateral promotions or transfers are generally exempt from taking the seminar-workshop unless otherwise directed.
    • Notification Process: Those required to attend must wait for the schedule issued by the Philippine Judicial Academy (PHILJA).
    • Non-attendance Protocol: Judges unable to attend upon being notified must immediately inform the PHILJA’s Chancellor and the Court Administrator in writing, detailing the reasons for their inability.
  • Immersion Program
    • Applicability:
      • All new and original appointees.
      • Judges of the first level courts promoted to the Regional Trial Courts who have taken their oath.
      • Judges with lateral promotions or transfers are not obligated to undergo the immersion program unless special directions are provided.
    • Duration and Timing:
      • New appointees must undergo an immersion program lasting one (1) month.
      • Judges promoted from first-level courts to the Regional Trial Courts must undergo a shorter immersion program lasting two (2) weeks.
      • The immersion program is to commence within ten (10) days from receipt of notice from the PHILJA.
    • Supervision: The immersion program will be conducted under the supervision of the Executive Judge noted in the notice.
    • Inability to Participate: Judges who cannot commence the immersion within the specified period must immediately notify the PHILJA’s Chancellor and the Court Administrator in writing, providing reasons for the delay.
  • Actual Assumption and Exercise of Judicial Office
    • Lateral Promotions/Transfers:
      • These judges are required to furnish the Office of Administrative Services (OCA) with copies of their oath, after which they can immediately resume their judicial functions.
      • If an acting presiding judge is in place, they must cease their functions upon the appointee’s actual assumption of the office.
    • For Judges of the First-Level Courts Promoted to the Regional Trial Courts:
      • Prior to the orientation seminar-workshop and while undergoing the immersion program, judges promoted to multiple-sala courts are limited to handling administrative matters only.
      • Those promoted to single-sala courts may already address urgent judicial matters (e.g., temporary restraining orders, preliminary injunctions, bail applications, habeas corpus petitions, etc.) even before undertaking the full program.
      • Following completion of the immersion program and, in some cases, after the orientation seminar-workshop, these judges may fully exercise their judicial functions.
      • The acting presiding judge, if assigned, will similarly cease duties upon the appointee’s completion of the respective immersion program.
    • For New and Original Appointees:
      • Despite having taken the oath, they are precluded from performing judicial functions prior to completing the orientation seminar-workshop and immersion program; however, they may attend to administrative matters.
      • Specific restrictions differentiate between those appointed to multiple-sala versus single-sala Regional Trial Courts, with the latter allowed to handle urgent judicial matters even after completing only the immersion program.
  • Payment of Initial Compensation
    • The accrual of the right to initial salaries begins on the first day of the orientation seminar-workshop or the immersion program, whichever occurs earlier.
    • Appointees are required to complete the pertinent documentation concerning their appointments promptly for the processing of their salaries.
    • The Office of Administrative Services (OCA) is tasked to handle the inquiries regarding this process.
  • Dissemination of Information
    • The Secretariat of the Judicial and Bar Council is responsible for providing all applicants for judicial office with copies of this resolution.
    • The resolution is intended as guidance and information for prospective nominees and appointees.
  • Promulgation and Effectivity
    • The resolution was promulgated on July 20, 1999, by a concurring body of justices headed by Chief Justice Davide, Jr. among others.
    • It takes effect on August 1, 1999.
