Submission Requirements for Law Enforcement Activities
- Enforcement personnel must submit to LETAS Encoding Section (Central Office) and the respective District or Regional Operations Office within 24 hours:
- Temporary Operator's Permit (TOP) with complete, accurate, and readable data including driver/operator, motor vehicle details, date, time, place of apprehension, and specific law violated.
- Confiscated driver’s license (DL).
- Daily Apprehension Report (DAR).
Encoding Procedures for Apprehensions
- Receiving Clerk must record date and time of DAR receipt.
- Apprehensions received from 8:00 a.m. to 12:00 noon encoded same afternoon.
- Apprehensions received from 5:00 p.m. onward encoded following morning (8:00 a.m. to 12:00 noon).
- Encoding under the "Apprehension Data Entry" tab; franchise-related violations encoded under "Alarm Data Entry" before adjudication.
- Alarm Summary must indicate TOP number, apprehension date, violation specifics, confiscated items, apprehending officer, and vehicle details.
Adjudication and Payment Process
- Violators to proceed to Traffic Adjudication Service (TAS) Central Office, District Office (DO), or Regional Operations Division (RO) for adjudication/payment.
- Admitted violations are immediately processed and a Resolution issued automatically.
- For suspensions, a "Notice of Suspension of DL/MV Registration" is generated; violator and officer signatures on printed Resolutions are no longer required.
Lost TOP Procedures
- Violators claiming lost TOP must submit an Affidavit of Loss and Police Blotter.
Procedures for Contesting Apprehensions
- Protest (written or position paper) to be filed within 5 days of apprehension.
- Protests for apprehensions by Regional Law Enforcement Unit (except NCR) filed with corresponding District or Regional Office, forwarded to the Operations Division within 24 hours.
- Protests for apprehensions by LTO Central Office enforcers or NCR RLEU filed directly with TAS Central Office.
- Failure to timely file protest is deemed admission.
- Appeals to TAS Resolution must be filed within 5 days of receipt, failure renders the resolution final and executory.
- Resolution of contested cases within 5 days of receiving protest.
Payment and Release of Confiscated Items
- After adjudication, violator pays fines to the Cashier.
- For admitted cases, violator redeems confiscated items at LETAS Releasing Unit.
- Compliance with accessory penalties is mandatory before release.
- Suspension or impoundment period begins only after payment is made.
- LETAS Releasing Unit updates status in Alarm and REMARKS indicating payment with official receipt number.
Accountability and Sanctions
- Failure of personnel to follow procedures results in disciplinary action per CSC rules and possible revocation of Deputation Order.
- Filing of criminal charges against erring personnel is without prejudice.
- Emphasis on strict and immediate compliance by all concerned.
