Title
UV Express Service Markings Requirements
Law
Ltfrb Memorandum Circular No. 2009-025
Decision Date
Feb 1, 2010
The LTFRB mandates a standardized white color scheme and specific markings for UV Express service vehicles nationwide, enforcing compliance to avoid penalties and potential franchise cancellations.

Program intent and legal basis

  • The Circular declares that the markings requirements reflect the true intent of the AUV/VAN Express Program.
  • The Circular links the intent of the markings to DOTC Department Order No. 2004-52.
  • The Circular also references “several circulars and issuances subsequent thereto” relating to color scheme and markings.
  • The Circular states that mandated markings are tied to franchise/CPC authorization and unit identification compliance.

Definitions and key concepts

  • The Circular uses the terms “UV Express Service” and “Authorized route” as part of the mandatory windshield and side markings.
  • The Circular uses “PUV Express units” to describe units authorized under franchise/CPC that must bear prescribed markings.
  • The Circular treats a unit’s “color scheme” and “unit(s) bearing different color” as compliance-critical features tied to franchise/CPC status.

Mandatory color scheme enforcement

  • The white color scheme required under the program must be mandatorily enforced nationwide.
  • The Circular provides that use of unit(s) bearing different color after the grant of Franchise/CPC is a sufficient ground for the recall/cancellation of Franchise/CPC for the unit involved.
  • The Circular provides that such use results in perpetual disqualification of the Operator to apply for any PUV Franchise/CPC.
  • The Circular’s color scheme rule applies as part of the mandatory marking regime for UV Express units.

Required UV Express markings layout

  • UV Express units authorized under franchise granted from the effectivity of this MC must bear the following markings.
  • At the upper portion of the windshield, the unit must show “UV Express Service” (4 in ht.) and “Authorized route” (2 in ht.).
  • At the middle portion of both sides of the unit, the unit must show “UV Express Service” (6.25 in ht.) and “Authorized route” (2 in ht.).
  • At the rear portion of both sides of the unit, the unit must show “Plate Number” (4 in ht.), “Name of Operator” (2 in ht.), “Case Number” (2 in ht.), and “Authorized number of passengers” (2 in ht.).
  • At the back portion of the unit, the unit must show “Operator’s contact number” (2 in ht.) and “LTFRB hotline number” (2 in ht.).

Compliance timing, inspection, and transition

  • Units under the AUV-Van Express/Point to Point (P2P)/Garage to Terminal (GT) Express Program that already bear the previous required markings are treated as having complied with the Circular.
  • The Circular imposes a transition inspection rule: prior to the confirmation of the unit by year 2011, the unit must undergo inspection, and the new required markings must be complied with.
  • The compliance deadline is therefore tied to the unit’s confirmation by year 2011, with inspection required before that confirmation.

Penalties and non-compliance consequences

  • Failure to comply with the required markings is penalized with a fine of PHP 3,500.00.
  • Failure to comply with the required markings also causes non-confirmation of the subject unit until compliance herewith.
  • Separately from the markings penalty, the Circular provides that using units with a different color after Franchise/CPC grant is a ground for recall/cancellation of Franchise/CPC and perpetual disqualification to apply for any PUV Franchise/CPC.

Effectivity, publication, and submission requirement

  • The Circular states it supersedes and amends all issuances inconsistent herewith.
  • The Circular takes effect after fifteen (15) days from its publication in the Official Gazette or in a newspaper of general circulation in the Philippines.
  • The Circular directs submission of three (3) copies to the UP Law Center for record purposes, pursuant to Presidential Memorandum Circular No. 11, dated Oct. 9, 1992.
