Purpose and policy basis
- The Order upgrades the basic salary for Filipino Able Seaman based on the upgraded rate reached during the 28th Session of the Joint Maritime Commission of the International Labour Organization.
- The upgrade is implemented after due consultations with industry associations and seafarer unions.
Coverage: Filipino Able Seaman contracts
- The Order applies to Filipino Able Seamen who are on board ocean-going vessels.
- The wage obligation is imposed on shipowners and principals.
- The Order governs the minimum basic wage to be paid for applicable shipboard employment.
Minimum wage and payment rule
- POEA Department Order No. 5, s. 2000 requires shipowners and principals to pay Filipino Able Seamen on board ocean-going vessels a minimum basic wage of US$385 per month.
- The duty is structured as a minimum basic wage obligation for covered seafarers.
When the upgraded wage applies
- The upgraded minimum wage applies to only contracts executed by Able Seaman upon the date of effectivity of the Order.
- Contracts executed by Able Seaman after the Order’s effectivity date are covered by the upgraded minimum basic wage requirement.
Non-impairment of existing contracts
- Shipboard employment contracts executed prior to the effectivity of the wage increase remain valid and unaffected by the Order.
- Existing contracts remain effective until their expiration or termination.
Adoption and compliance mandate
- The Order is adopted on 31 May 2000.
- The Order is signed by Bienvenido E. Laguesma, Secretary.
