Prohibited Acts

  • Making, publishing, disseminating, circulating, or placing before the public any advertisement related to merchandise, securities, services, or anything offered to the public.
  • Advertisement must not contain assertions, representations, or statements of fact that are intentionally untrue, deceptive, or misleading.
  • Liability attaches to both direct and indirect causes of such advertisements.

Intent Requirement

  • The untrue, deceptive, or misleading advertisement must be made with the intent to sell, dispose, increase consumption, induce public obligations, or cause acquisition of interest or title.

Penalties

  • Violation constitutes a misdemeanor.
  • Punishable by a fine up to six hundred pesos, or imprisonment up to six months.
  • Court discretion to impose either or both penalties for each offense.

Repeal of Conflicting Laws

  • All prior Acts, ordinances, or parts thereof inconsistent with this Act are expressly repealed.

Effectivity

  • The Act took effect on July 1, 1914.
