Grounds for Deportation Related to Unfair Labor Practices by Aliens
- Establishes that any unfair labor practice committed by an alien employee is a valid ground for deportation.
- Unfair labor practices by the president, manager, or person-in-charge of an establishment owned by an alien are attributed to the alien owner if:
- The alien owner had knowledge of the unfair labor practice or was notified thereof.
- The alien owner did not take corrective steps within 24 hours after notification.
- Such unfair labor practices committed or tolerated by the alien owner can also serve as grounds for his deportation.
Court Orders and Compliance
- The Court’s order may require the offending party to post the findings and order in a place accessible to all employees.
- The offending party may be required to submit periodic reports indicating compliance with the Court’s order.
Dismissal of Complaints
- If after investigation the Court finds no unfair labor practice, it shall issue an order dismissing the complaint.
- Similarly, if the complainant withdraws the complaint, the Court is mandated to dismiss the case.
Effectivity
- The Act took effect immediately upon its approval, strengthening enforcement mechanisms against unfair labor practices involving aliens in the Philippine labor sector.
