Authority, legal basis, and purpose
- The order is issued by the President pursuant to powers vested by law, directing transfer of supervision.
- Executive Order No. 426 recognizes the Department of Trade and Industry (DTI) as the Executive Branch arm for trade, industry, and investment.
- Executive Order No. 426 recognizes that Manila Economic and Cultural Affairs (MECO) was established to promote cooperation between the Philippines and Taiwan, including in economic and trade matters on a people-to-people basis.
- Executive Order No. 426 mandates supervision by the Secretary of Trade and Industry to facilitate coordination of trade, investment, and economic policies and programs.
Policy supervision over MECO functions
- Section 1 transfers policy supervision over MECO’s functions in the field of trade, investment and other economic matters to the Secretary of the Department of Trade and Industry.
- Section 1 requires that the Secretary of DTI exercises supervision specifically for MECO’s trade, investment, and other economic matters activities.
Repeal, modification, and relationship to prior issuances
- Section 2 repeals, modifies, or amends accordingly Executive Order No. 328 (s. 2004).
- Section 2 also repeals, modifies, or amends all other Executive Orders, issuances, rules and regulations that are inconsistent with Executive Order No. 426.
- Section 2 operates to align existing rules with the transfer of supervision under Section 1.
Immediate implementation effect
- Section 3 makes the operative transfer of supervision effective immediately upon issuance.
- The effectivity rule ensures that DTI’s Secretary assumes the supervision role established in Section 1 without delay.
