Creation and Composition of the Transition Committee

  • A Transition Committee is established to assist the DOH in implementing the transfer of TRCs.
  • The Committee is chaired by the DOH and includes members from the Department of Interior and Local Government (DILG), Department of Justice (DOJ), Department of Budget and Management (DBM), and Private Sector Representative of the Dangerous Drugs Board (DDB).
  • The Committee ensures actual resource transfer from PNP and NBI to DOH, including newly constructed buildings.
  • It guarantees no personnel displacement; personnel have the option to stay with their original units or transition to DOH.
  • The Committee ensures smooth turnover and administrative control transition of TRCs.

Funding Provisions

  • An initial P350 million is allocated from the P1 billion standby fund for the Anti-Dangerous Drugs Campaign for DOH to immediately assume operation and improvement of TRCs in 2004.
  • The budget for TRCs previously under PNP and NBI will be transferred to DOH in the General Appropriation Act (GAA) for Fiscal Year 2005.
  • The Department of Budget and Management (DBM) will identify specific allotments covering personnel salaries and maintenance operating expenses.
  • DBM is also tasked to provide an additional P300 million in GAA FY 2005 for hiring more personnel, training existing staff, modernizing and expanding facilities, and establishing new TRCs, especially in regions without existing centers.

Legal Effect and Continuity Clause

  • If any provision of this Executive Order is declared invalid by a competent court or tribunal, the other provisions remain unaffected and continue to be in full force and effect.

Immediate Effectivity

  • The Executive Order is effective immediately upon signing.
  • Signed in Manila on January 20, 2004, by President Gloria Macapagal-Arroyo and Executive Secretary Alberto G. Romulo.
