Constitutional and statutory basis
- Executive Order No. 586 is issued under the President’s authority under Section 31, Chapter 10, Title III, Book III, of the Administrative Code of 1987, which grants continuing authority to reorganize the government.
- Executive Order No. 586 is anchored on Executive Order No. 380 (series of 2004), which mandates PRA to develop, improve, administer, deal in, subdivide, dispose, lease, and sell government-owned real property.
Purpose and policy rationale
- Executive Order No. 586 recognizes that PRA holds and manages assets “in behalf of the National Government.”
- Executive Order No. 586 recognizes that PRA converts underutilized government land into income-generating real estate properties and delivers projects and services relied upon for kind development and urban renewal.
- Executive Order No. 586 frames reclamation, land development, and urban renewal as essentially public works.
Transfer of PRA to DPWH
- Section 1 transfers the Philippine Reclamation Authority (PRA) from the Department of Finance (DOF) to the Department of Public Works and Highways (DPWH).
- Section 1 effects the institutional placement of PRA under DPWH for purposes of administration and supervision within the government reorganization.
Repeal and modification of inconsistent issuances
- Section 2 provides that all orders, issuances, rules and regulations, or parts thereof inconsistent with Executive Order No. 586 are repealed or modified accordingly.
- Section 2 makes the repeal/modification automatic for inconsistency, covering both whole issuances and portions that conflict with the transfer directive.
