Legal Basis and Prior Organizational Status
- PITC was created under Presidential Decree No. 252 (s. 1973) and is classified as a line corporate agency under the DTI per the Administrative Code of 1987.
- The Governing Board of PITC was reorganized by Executive Order No. 326 (July 9, 2004) to improve coordination and supervision.
- Section 15(4), Chapter 7, Title X, Book IV of the Administrative Code classifies PITC as a government entity supervised by the Undersecretary for International Trade within the DTI.
Rationale for the Transfer
- The transfer is justified by the need for closer monitoring and more effective oversight of PITC's role in delivering on the Government's commitments under the President’s 10-Point Legacy.
- The President has continuing authority to reorganize the administrative structure of the Office of the President as provided in Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1987.
Effect of the Executive Order
- All executive issuances, rules, regulations, or parts that conflict with this Order are revoked, amended, or modified accordingly.
- This ensures that no legal obstacles remain for implementing the transfer and that prior inconsistent provisions are superseded.
Effectivity
- The Executive Order takes immediate effect upon its promulgation on August 9, 2004.
- This immediate effect ensures uninterrupted operation and administrative transition of PITC to the Office of the President.
