Mandate and Core Responsibilities

  • PCG remains the primary agency responsible for promoting the safety of life at sea.

Legal Basis for Transfer

  • The transfer is authorized under Section 31, Chapter 10, Title III, Book III of EO 292 (Administrative Code of 1987), granting the President authority to reorganize the Office of the President.

Establishment of Transition and Liquidation Committee

  • A Transition and Liquidation Committee is created to facilitate the transfer.
  • Committee chaired by the Department of Transportation and Communications (DOTC).
  • Members include the Philippine Navy, PCG, Department of Budget and Management, and the Office of the President.
  • The Committee must:
    • Recommend plans and measures for transfer within 30 days from the signing of the Executive Order.

PCG Assets and Appropriations

  • All appropriations and assets under PCG control — including vessels, watercraft, firearms, armaments, communication equipment, vehicles, buildings, real estate, and lighthouses — are transferred to PCG under the Office of the President.
  • Appropriations for PCG at the time of approval continue and must be carried forward in the General Appropriations Act.
  • PCG prepares its own budget as a Key Budgetary Item (KBI) thereafter.

Pay, Allowances, and Retirement of Uniformed Personnel

  • PCG uniformed personnel retain the same base pay, longevity pay, and other benefits as their counterparts in the Armed Forces of the Philippines (AFP).
  • PCG personnel remain covered by Presidential Decree 1638 (AFP Retirement Law), as amended, until PCG can establish its own retirement system under an agreed regime and timetable.

Repealing Clause

  • All executive orders, rules, regulations, or parts thereof contrary or inconsistent with this Order are repealed or modified accordingly.

Effectivity

  • The Executive Order takes effect immediately upon signing.
