Legal Authority and Government Powers
- The President exercises authority under Section 31 (3), Chapter 10, Title III, Book III of the Administrative Code of 1987, which authorizes the President to transfer any agency under the Office of the President to any other department or agency.
Purpose and Policy Statement
- The Executive Order recognizes DTI as the primary coordinative, promotive, facilitative and regulatory arm of the Executive Branch in trade, industry and investment.
- The Executive Order recognizes the Intellectual Property Office (IPO) as the principal government agency tasked to oversee and implement state policies on the protection and enforcement of intellectual property rights.
- The Executive Order directs that placing the IPO under DTI is necessary to facilitate coordination of policies and programs between the agencies.
Transfer of IPO to DTI
- Section 1 transfers the Intellectual Property Office (IPO) from the Office of the Executive Secretary to the Department of Trade and Industry.
- Section 1 provides that the IPO is attached to the Department of Trade and Industry.
- The transfer is implemented by operation of the Executive Order without requiring additional conditions stated in the Order.
Repeal of Inconsistent Issuances
- Section 2 repeals or modifies any orders, issuances, rules and regulations or parts thereof that are inconsistent with OP Executive Order No. 346.
- The repeal or modification applies only to the extent of inconsistency.
Adoption, Signing, and Administrative Issuance Effect
- The Executive Order was adopted on 09 Aug. 2004.
- It was signed under the President by (SGD.) ALBERTO G. ROMULO, Executive Secretary.
- Section 3 makes the transfer effective immediately upon effectivity of the Executive Order.
