Declaration of Policy

Continuity of Contracts and Obligations

Transfer of Properties and Assets

  • SDA transfers all assets including land, infrastructure, equipment, furniture, and records to BCDA for administration and usage by CDC.
  • An official inventory of SDA properties will be conducted to establish accountability.

Personnel Transfer and Employment Status

  • Permanent SDA employees absorbed into CDC in a hold-over capacity, continuing duties and receiving existing salaries and benefits.
  • CDC to complete organizational restructuring within sixty (60) days.
  • SDA employees opting not to transfer will be considered separated and entitled to benefits under Civil Service laws.

Funding Allocation and Management

  • Funds allocated for SDA in the 1996 General Appropriations Act and other sources transferred to BCDA.
  • BCDA through CDC to allocate necessary funds for immediate program and project implementation.

Settlement and Resettlement of Communities

  • CDC authorized to transfer and resettle communities in Sacobia at BCDA expense.
  • Resettlement subject to legal rights and validated ancestral domain claims by the Department of Environment and Natural Resources.

Reporting Requirements

  • Quarterly implementation status report to be submitted jointly by BCDA and CDC to the President via the Office of the Executive Secretary.

Repealing Clause

  • Any inconsistent presidential issuances, rules, and regulations are repealed, amended, or modified to conform with this Order.

Separability Clause

  • If any provision is declared unconstitutional or unlawful, the rest of the Order remains effective.

Effectivity

  • The Order takes effect fifteen (15) days after full publication in a newspaper of general circulation.
