Executive Order No. 161 extends the term of Executive Order No. 371, establishing the Special Zone of Peace and Development in the Southern Philippines, to allow for the completion of peace agreements and accelerate socio-economic development programs in the region.

Continuity of Organizational Structure and Responsibilities

  • The existing organizational setup, functions, and responsibilities of the SPCPD and the CA as originally defined under EO 371 remain fully in force during the extension period.
  • This ensures an unbroken implementation of peace and development initiatives within the SZOPAD.

Enhanced Mandate of the Southern Philippines Council for Peace and Development

  • SPCPD is tasked with direct supervision over key government offices and development authorities operating in SZOPAD, specifically:
    • Southern Philippines Development Authority (SPDA)
    • Office of Muslim Affairs (OMA)
    • National Commission on Indigenous People (NCIP), previously the Office of the Southern Cultural Communities
  • Development-focused task forces such as Basilan Development Task Force, Central Mindanao Development Task Force, and Sulu Development Task Force are also placed under SPCPD’s control.
  • These roles derive authority from the 1996 Final Peace Agreement between the Government of the Republic of the Philippines and the Moro National Liberation Front.

Safeguard of Local Government Unit Powers

  • EO No. 161 explicitly preserves the existence and legal powers of all local government units within SZOPAD, including those of the ARMM.
  • The Executive Order does not diminish or affect their authorities as granted by existing laws.

Funding Provisions

  • Financial support for SPCPD and the Consultative Assembly will continue coming from the Office of the President.
  • Additional funding sources may be identified and recommended by the Department of Budget and Management to ensure operational capability.

Effectivity Clause

  • This Executive Order took effect fifteen (15) days after its publication in two newspapers with national circulation.
  • The dated effectivity aligns implementation timelines to allow legal and administrative compliance by concerned agencies and local governments.
