Amnesty Period and Conditions
- Amnesty valid for one year from the Order's effectivity, excluding COMELEC-declared election ban period (Jan 14 to June 13, 2007).
- Firearms must be surrendered to the Philippine National Police (PNP) for custody.
- Each firearm submitted must have a distinct description for individual licensing.
- Amnesty intended for those who missed previous programs under EO 171 and EO 390.
Licensing of Firearms and High-Powered Firearms
- Generally, high-powered rifles/"paltik" firearms are not eligible for licensing.
- The Chief of PNP may grant exceptions allowing some high-powered firearms to be licensed.
- Persons surrendering firearms under amnesty are exempt from prosecution for illegal possession during the act of surrender.
Amnesty Fees
- Fee for licensing high-powered firearms: PHP 3,000.00 per firearm.
- Fee for licensing low-powered firearms: PHP 2,000.00 per firearm.
Utilization of Collected Fees
- Fees are treated as trust liabilities and deposited in a Special Account in an Authorized Government Depository Bank (AGDB).
- Proceeds support nationwide implementation of Firearms Information Management System (FIMS), Firearms Records Management System, and Firearms Ballistic Information System.
- Unspent funds will revert to the General Fund.
Allocation of Fees for Police Offices
- 20% of gross proceeds retained by Firearms and Explosives Division (FED), Civil Security Group (CSG), Regional Offices, and Provincial/City Police Offices involved in licensing.
- Retained funds used to cover direct licensing operation costs.
Implementing Rules and Regulations
- Chief PNP tasked with issuing implementing rules and regulations (IRR).
- IRR subject to approval/concurrence by the Secretary of the Interior and Local Government.
Repeal of Inconsistent Orders
- All prior orders, issuances, rules, and regulations inconsistent with this Order are repealed or modified accordingly.
Effectivity
- The Order takes effect immediately from its signing date on December 11, 2006.
