Powers and Duties of the Games and Amusements Board

Permits for Conducting Professional Games

  • It is unlawful to conduct professional basketball or other professional games without a permit issued by the Board.
  • Permits must specify the issuer, location, and date of the games.

Licensing Requirements

  • All players, referees, scorers, timekeepers, and other related personnel must be licensed annually by the Board.
  • Licenses may be revoked for dishonesty, fraud, violations, or just cause.

Official Assignments at Games

  • The Board assigns licensed officials to each game.
  • Only designated officials have authority during games.

Duties of Persons or Entities Conducting Professional Games

License Fees

  • Professional basketball teams: P100 annually.
  • Coaches and players: P50 annually each.
  • Referees: P50 annually.
  • Timekeepers, scorers, and other licensed persons: P20 annually.
  • Fees accrue to the Board's funds.

Admission Tickets and Income Supervision

  • The Board supervises ticket sales; tickets must state price, organizer, teams, and date.
  • No ticket may be sold above the printed price without Board approval.
  • Organizers remit 3% of gross gate receipts and income from broadcast rights to the Board.
  • Philippine Basketball Association games are subject only to a 5% amusement tax on gross ticket sales.

Civil Service Law and Employment Status

  • Appointments related to supervision and regulation are subject to Civil Service laws but exempt from Wage and Position Classification Office coverage.

Appeals Process

  • Appeals from Board orders or decisions on basketball matters may be filed with the Office of the President within 72 hours.
  • The President's decision is final.

Forfeiture of Fees

  • Fees paid for licenses or permits are forfeited upon cancellation or revocation.

Separability Clause

  • If any provision is declared unconstitutional, the rest remain valid.

Repealing Clause

  • Inconsistent laws, decrees, orders, or regulations are repealed or modified accordingly.

Effectivity
