Coverage and Scope of Legal Protection
- Protection covers various categories of children including:
- Physically abused children, victims of cruelty and corporal punishment
- Sexually abused children, including rape and other sexual assaults under the Revised Penal Code
- Children in prostitution and obscene shows
- Trafficked children under RA 7610 and RA 9208
- Child labor victims, especially worst forms
- Indigenous and Muslim children
- Children affected or involved in armed conflict
- Abandoned and neglected children
- Children experiencing abuse, exploitation, discrimination
- Other categories as identified requiring assistance
- Emphasis on violent crimes against children, cases affecting national interest, and those needing urgent action
Composition of the CSPC
- Chaired by Secretary of Justice, co-chaired by Secretary of Social Welfare and Development
- Members include:
- Chairperson of Commission on Human Rights
- Secretaries of Foreign Affairs, Labor, Tourism, Interior and Local Government, Health, Education
- Commissioners and Chiefs from Immigration, National Bureau of Investigation, Philippine National Police
- Prosecutor General
- Three representatives from NGOs/Private organizations advocating child protection, appointed for renewable 3-year terms
- Secretariat support provided by the Council for the Welfare of Children (CWC)
Functions and Duties of the CSPC
- Establish reporting system for case monitoring among member agencies
- Request immediate action from member agencies on pressing issues
- Coordinate with other inter-agency councils to harmonize child protection efforts
- Develop policies and guidelines to address gaps in investigation, prosecution, and legal child protection
- Formulate uniform protocols for capacity-building emphasizing multi-disciplinary approaches
- Seek assistance from non-member agencies as needed
- Submit annual accomplishment reports to the Office of the President
- Perform other necessary functions to fulfill the Order's objectives
Legal and Procedural Provisions
- Repeal and modification of inconsistent prior issuances to harmonize with this Order
- Separability clause ensuring validity of other provisions if any part is invalidated
- Immediate effectivity upon publication in a newspaper of general circulation
