Appropriation for Salary Differentials
- Appropriation Decree No. 233 allocates ₱14,185,000 for salary differentials of Judiciary officials including judges.
Salary Fixing for City Judges (Section 1)
- Salaries standardized despite contrary existing laws.
- Fixed salary rates:
- Cities of Manila, Quezon, Caloocan, Pasay, Baguio, and Cebu: ₱35,000 per annum.
- Second and third class cities: ₱25,000 per annum.
- Other cities: ₱20,000 per annum.
Payment of Salary Differentials and Future Salary Payments (Section 2)
Salary differentials paid from the appropriated fund in P.D. No. 233 starting January 1, 1974.
Future salary payments handled according to city classification and funding sources:
Cities paying judges' salaries fully:
- Salaries paid in full by the city government.
- If city classification is downgraded, the national government pays the salary differential.
Cities paying salaries fully by the national government:
- National government continues full payment.
- Cities may share payment when financially able, as determined by the Secretary of Finance.
Cities sharing salary payments with the national government:
- Continue proportionate sharing according to existing ratios.
- Increased city revenues may increase city’s share and decrease national government’s share, as determined by the Secretary of Finance.
- Goal is for cities to eventually assume full salary payment for their city judges.
Legal Authority and Effectivity
- Authority: Exercised by the President of the Philippines under the Constitution.
- Effectivity: Salary adjustments and differentials retroactive to January 1, 1974.
