Validity Period of the SWP

  • An SWP is valid for a period of three (3) months from the date it is issued.
  • During this period, the holder of the SWP may provisionally assume the duties and responsibilities of the job position applied for.

Extension of the SWP

  • The SWP may be extended by the Commission upon the written request of the petitioning company.
  • Such extension requests must be submitted at least thirty (30) days before the expiration of the SWP.
  • Extensions are granted only for compelling reasons, ensuring that temporary work authorization is not unduly prolonged.

Governing Authority and Implementation

  • The provisions are a supplement to previous Law Instruction Nos. 27 and 42 concerning Special Work Permits.
  • The effective implementation is overseen by the Commission, represented by the Commissioner at the time of issuance.
