Licensing Requirements and Procedures for PCOB-Registered Companies

  • Submission of written application with:
    • Certified copy of valid PCOB Certificate of Registration.
    • Proof of payment of non-refundable P5,000 filing fee.
  • Upon approval:
    • Payment of P30,000 licensing fee.
    • Posting of cash bond (P100,000) and surety bond (P500,000).
    • Presentation of escrow agreement proof with accredited bank (P200,000).
  • License validity:
    • At least two years, coterminous with PCOB registration validity.
    • May be cancelled, revoked, or suspended for violations of labor laws and regulations.
    • Valid only at specified location and for licensed company use.
  • Renewal requirements:
    • Certified PCOB Certificate of Renewal.
    • Renewed surety bond proof (P50,000).
    • Certification that escrow deposit (P200,000) remains intact.
    • Proof of P30,000 license fee payment.

Registration of Overseas Projects

  • Letter request to POEA Landbased Center for project registration.
  • Must submit:
    • Project authorization from PCOB detailing manpower, compensation, and mobilization schedule.
    • Master employment contract.

Procedures for In-House Processing of Overseas Employment Certificates (OECs)

  • Issuance of pre-numbered OECs:
    • Requires letter-request based on project authorization.
    • One-time affidavit of undertaking covering:
      • Deployment exclusively to duly registered projects.
      • Registered job positions/classifications and salary rates.
      • Valid work visas or equivalent for OFWs.
      • OFWs not included in any watchlist.
      • Contracts duly registered with POEA and copies given to OFWs before departure.
      • Responsibility and liability of PCOB-registered company for OEC management.
      • Subject to regular audit and spot inspection.
    • Official receipt of OEC payment.
    • Computerized system report meeting POEA specifications.
  • For Balik-Manggagawa workers:
    • Letter-request, official receipt, valid visa/work permit, and proof of prior processing needed.
  • Replenishment requests require justification with proof of project needs.

Issuance and Validity of OECs

  • Issuance based on registered job classification and salary.
  • Companies ensure that appropriate visas are secured; use of unregistered visa statuses requires POEA clearance.
  • OECs signed by authorized company signatories (max three), whose specimen signatures are forwarded for reference.
  • OEC validity:
    • 120 days for new hires.
    • 30 days for Balik-Manggagawa.
  • Lost OECs require full travel tax payment; replacements issued only in specific cases.
  • License suspensions demand administrative clearance before worker deployment.

Deployment List Submission

  • Companies must submit deployment list to Labor Assistance Center (LAC) at Philippine airports.
  • List includes names, positions, overseas projects, and departure dates.
  • LAC validates and forwards to Landbased Center for monitoring.
  • List must reflect actual deployed workers.

Payment of OWWA Contributions

  • OWWA membership and Medicare payments must be made immediately after the workers' departure or on next working day if departure is on non-working day.
  • Manager's and cashier's checks accepted.

Revocation and Suspension of In-House Processing Privileges

  • POEA may recall in-house processing privileges for non-compliance or rule violations.
  • Automatic preventive suspension imposed for guideline violations.

Monthly Audits on OEC Stock and Usage

  • Monthly report required on OEC consumption, remaining stock, cancellations, spoiling, expirations, and missing certificates.
  • Report includes original and POEA copies of OECs and OFW info sheets.
  • Report deadline: 5th day of each month.
  • Missing OECs must be reported within 48 hours with affidavit explaining the loss.
  • Notice of loss to be published in a widely circulated newspaper.
