Authority Limits for Homestead and Free Patents

  • PENRO authorized to approve homestead/free patents up to 6 hectares.
  • RED authorized to approve homestead/free patents exceeding 5 hectares up to 10 hectares.

Authority Limits for Land Sales

  • PENRO authorized to approve sales of public land up to 1,000 square meters.
  • RED authorized to approve sales exceeding 1,000 square meters up to 5 hectares.

Insular Government Property Sales Application and Government Sales Application

  • RED authorized to approve sales applications involving public land up to 3 hectares.
  • The RED of the National Capital Region (NCR) has additional authority to approve miscellaneous sales patents and deeds of sale of patrimonial properties under Presidential Proclamations within Metro Manila.

Approval Authority for Larger Areas

  • Any patents or Public Land Applications exceeding the specified limits must be approved/signed by the Secretary of DENR.

Other Public Land Applications

  • Signing authority for other applications, orders, and documents related to Public Land Applications (PLAs) that are not expressly covered by this Order remain unchanged.
  • Appraisal signing authority aligns with the levels established for patent approval.

Monitoring and Compliance

  • Regional Offices are tasked to conduct quarterly random reviews on the quality of patents processed and issued by the regional and field offices.
  • Quarterly compliance reports must be submitted to the Central Office through the Undersecretary for Field Operations, with copies to the DENR-CARP National Secretariat.
  • Reports must include duplicate copies of the transmittal letter received by the concerned Registry of Deeds.

Processing of Pending Documents

  • Documents currently pending with the Central Office will continue to be processed and signed by the Secretary of DENR.
  • Regional Offices shall refrain from forwarding documents within their signing authority limits to the Central Office henceforth.

Information and Education Campaign

  • A nationwide information and education campaign will be conducted by Regional Offices and the DENR-CARP National Secretariat to inform stakeholders of the provisions of this Order.

Effectivity and Revocation

  • The Order takes effect immediately upon issuance.
  • It revokes and supersedes all previous issuances, orders, and instructions inconsistent with its provisions.
