Application filing requirements
- Section 2 requires every applicant for a sawmill operating permit to file with the Director of Forestry a statement.
- Section 2 requires the statement to include: (1) the name, citizenship, and residence of the owner or operator of the sawmill, or the name of the association or corporation if the applicant is an association or corporation; (2) a description of the equipment used; (3) the cost or value of the equipment; and (4) the location of the sawmill.
Posting the permit on the premises
- Section 3 requires each sawmill operating in accordance with the Act to display on its premises, in a prominent place exposed to public view, the permit issued under the Act.
Rules, regulations, and annual fees
- Section 4 authorizes the Director of Forestry, with the approval of the Secretary of Agriculture and Natural Resources, to issue rules and regulations necessary to carry out the Act.
- Section 4 includes authority to prescribe annual fees for permits granted thereunder.
- Section 4 provides that annual fees must be graduated based on the output of the sawmills.
- Section 4 sets an absolute cap: annual fees shall in no case exceed PHP 1,000 for any permit.
Penalties for operating without a permit
- Section 5 penalizes any person, association, or corporation that operates a sawmill without the prescribed permit.
- Section 5 also penalizes any person, association, or corporation that violates any provision of the Act or any rules and regulations issued thereunder.
- Section 5 fixes the penalty as a fine of not less than PHP 1,000 and not more than PHP 10,000.
Effectivity and date
- Section 6 provides that the Act takes effect upon its approval.
- The Act was Approved: June 8, 1950.
