Requirements for Application

  • Applicants may be authors, their heirs, or assignees, applying personally or through representatives.
  • Non-resident applicants can be represented by a resident agent.
  • Documentary requirements include:
    • Affidavits under Sec. 218 of IP Code establishing ownership.
    • Death, birth, marriage, or heir designation documents as applicable.
    • Identity proof for natural or juridical persons.
    • Authority documents for representatives.
    • Official receipt or validated deposit slip.
    • The work must be deposited per prescribed manner.
  • Filing fees consist of a basic fee, courier fee, and administrative expenses, with a detailed fee schedule.

Manner of Deposit

  • Works must be deposited according to their class:
    • Class A to I cover writings, periodicals, speeches, dramatic compositions, music, artworks, designs, etc.
    • Deposits can be original copies, electronic copies online, or on storage medium.
    • Specific formats for photographs or music sheets apply for some categories.

Procedure for Registration

  • The applicant submits an accomplished RDF and required documents to IPSO or IPFOU.
  • The IPSO Field Specialist reviews, categorizes the work, and verifies completeness.
  • The applicant pays the prescribed filing fee; one fee covers multiple classes.
  • Official receipts and acknowledgement receipts are issued.
  • Documents are encoded, scanned, and transmitted electronically for verification.
  • Certificates are printed and released within five working days after filing.
  • Corrections to ownership, authorship, and title are final unless substantial and requested with an additional fee.
  • The certificate contains detailed information including owner, title, author, work class, creation date, protection term, and official signatures.

Post-Registration

  • Deposited works are transmitted monthly by IPSOs to the BCRR and semi-annually to the National Library.
  • The IPOPHL Director General can cancel certificates for final court orders, IPOPHL legal orders, registrations of rights transfer, or copyright expiry.
  • Certified true copies of certificates can be requested for a fee.
  • The copyright database is jointly administered by NLP and IPOPHL.

Final Provisions

  • If any part of the rules is invalid, the remaining provisions remain effective.
  • Three certified copies of these rules are filed with the UP Law Center; certified copies sent to key government offices.
  • The rules take effect 15 days after publication.
