Voting requirement for pending petitions

  • Approval of any pending petition for naturalization under Presidential Decree No. 1379 requires the unanimous vote of all members of the Committee.

Prohibition on follow-ups

  • The petitioner or any person acting in his behalf is prohibited from following up, either directly or indirectly, the petitioner’s application or petition.
  • The petitioner must wait for official calls for interview and personal appearance.

Misrepresentation and rule violations

  • Any false statement of misrepresentation in the petition or in any submitted documents constitutes adequate basis for denial of the petition.
  • Any violation of the Rules and Regulations by the petitioner or his duly authorized representative constitutes adequate basis for denial of the petition.
  • Denial results when misrepresentation or rule violations occur, consistent with the Rules’ prescribed screening and processing.

Committee action, approval, and disapproval

  • The Committee approves a petition when, from screening and further processing, it finds that the petitioner has all qualifications and none of the disqualifications for naturalization prescribed by law.
  • The Committee’s approval is issued in consonance with Executive Order No. 460, as amended.
  • The Committee issues a certificate of naturalization after the petitioner completes oath-taking.

Oath-taking schedule, filing requirements, and form

  • The petitioner must take the oath of allegiance on the date specified in the notice, and that date must be within thirty (30) days from the date the Committee approved the petition.
  • The petitioner takes the prescribed oath before the Committee or its duly designated representatives, upon payment of the oath-taking fee.
  • The petitioner must file six (6) copies of the oath of allegiance, duly subscribed before the Committee or an officer authorized to administer oath, with the Committee on the same date the oath is taken.
  • The official receipt of payment of the oath-taking fee in the petitioner’s name must be attached to the original copy of the oath, and duly certified photocopies of the official receipt must be attached to the duplicate originals of the oath.
  • The Rules prescribe the exact OATH OF ALLEGIANCE wording, including renunciation of allegiance to any foreign prince, potentate, state, or sovereignty; support and defense of the Constitution; obedience to laws and legal orders; recognition of the supreme authority of the Republic of the Philippines; and voluntary assumption without mental reservation or purpose of evasion.

Effects after oath and civil registration

  • After oath-taking, the Committee issues a certificate of naturalization.
  • The Committee forwards the certificate of naturalization together with a copy of the oath to the proper Local Civil Registrar for registration.
  • The Committee also forwards another copy of the oath to the Bureau of Immigration and Deportation (BID).
  • The Bureau of Immigration and Deportation cancels the Alien Certificate of Registration of the naturalized citizen.

Committee personnel and allowances

  • The Committee appoints an Executive Director, an Assistant Executive Director, and other personnel to assist it in performing its functions.
  • The functions of the Executive Director, Assistant Executive Director, and other personnel are defined by the Committee.
  • Appropriate allowances must be provided for all personnel assigned and/or detailed to the Committee, in amounts fixed by the Solicitor General.

Amendments and adoption details

  • Any amendment to the Rules and Regulations requires unanimous approval of the Committee members.
  • The Rules are adopted on 18 Sept. 1998.

Notice: application forms, supporting documents, and deadline

  • Petitioners/applicants for naturalization under Presidential Decree No. 1379 with approved or pending petitions before the Special Committee on Naturalization must secure their application forms from the SCN Secretariat at the Office of the Solicitor General, 134 Amorsolo St., Legaspi Village, Makati City, and must fill them up with updated data.
  • Petitioners/applicants must submit with their petitions the required supporting documents, as applicable, including:
    • Affidavits of two (2) character witnesses.
    • Marriage contract, if married.
    • Birth certificate of petitioner.
    • Birth certificate of children.
    • Latest passport.
    • Latest Alien Certificate of Registration.
    • Latest Immigration Certificate of Registration.
    • Medical certificate from a government physician.
    • Clearances from:
      • Regional Trial Court in the place of residence,
      • Police in the place of residence,
      • National Bureau of Investigation,
      • Provincial or City Prosecutor in the place of residence.
    • Original or certified true copies of the petitioner’s Income Tax Returns and receipts of payment of income tax for the last three (3) years.
    • Additional supporting documents, including:
      • Original of certified copy of the birth certificate of petitioner’s wife, if native-born,
      • Certificates of enrollment of petitioner’s minor children of school age,
      • Other documents the petitioner may desire to attach.
  • The updated verified petition and supporting documents must be filed with the SCN Secretariat not later than April 30, 1999, otherwise the petition is deemed abandoned.
