Delineation of Responsibilities of DENR

  • Verify PLAs and TLAs through CENROs, PENROs, and REDs for expiration or cancellation due to non-compliance or regulatory violations.

  • Notify DAR Secretary regarding available areas within cancelled or expired agreements for CARP.
  • Conduct inventory of occupants-cultivators within subject areas jointly with DAR.
  • Subdivide occupied lands into parcels not exceeding 3 hectares, unless distributed collectively, coordinated with DAR.
  • Provide application forms for Certificate of Stewardship (CS) under the Integrated Social Forestry (ISF) Program.
  • Accept and process applications and collect related fees through regional offices.
  • Conduct investigation and ocular inspections.
  • Prepare and approve Certificate of Stewardship contracts for beneficiaries.

Delineation of Responsibilities of DAR

  • Verify if occupants-cultivators are registered as prospective beneficiaries as per DAR Administrative Order No. 10, 1989.
  • Screen unregistered occupants-cultivators to determine their qualifications.
  • Prioritize registered beneficiaries, with preference to actual occupants-cultivators.
  • Endorse qualified ARBs to DENR officials.
  • Assist ARBs in application preparation.

Additional Presidential Authority

  • The President may authorize resettlement of natural calamity victims on lands covered by this order, based on recommendations from DAR, DENR, and DSWD.

Procedural Steps

  1. DENR Secretary identifies and declares expired or cancelled leases available for CARP.
  2. DAR verifies registration of occupants-cultivators; conducts inventory if needed.
  3. DAR prioritizes allocation to registered actual occupants in coordination with DENR.
  4. DENR conducts surveys of allocated parcels.
  5. Applicants, assisted by DAR, file CS applications with certification from Municipal Agrarian Reform Officer (MARO) at DENR/CENRO offices.
  6. DENR/CENRO receives and processes applications complete with required documents.
  7. Certificates of Stewardship for areas up to 3 hectares are issued by CENRO.

Dispute Resolution Mechanism

  • Qualification or eligibility disagreements at CENRO/MARO level resolved by PENRO-PARO.
  • Appeals beyond PENRO-PARO decisions may be elevated to the joint DENR-DAR Regional Directors whose decision is final.

Reporting and Accomplishments

  • DENR Regional Offices include number and hectarage of Certificates of Stewardship issued in monthly reports to DENR Secretary.
  • DAR Regional Offices report the number of screened beneficiaries who received Certificates, credited as accomplishment.

Effectivity

  • The Order is effective immediately upon issuance on February 14, 1992.
  • Signed by Secretaries of the Department of Agrarian Reform and Department of Environment and Natural Resources.
