General Provisions

  • NC-TVRO operations require Registration Certificate and permits to purchase/possess.
  • C-TVRO operations require permits to purchase, possess, construct; plus a radio station license.
  • Use of TVRO programs must comply with copyright laws.
  • Use of de-scrambling/decoding devices prohibited without written authorization.
  • Non-commercial authorization is granted to individuals, groups, government agencies, UN entities for non-fee personal/premises use.
  • Commercial authorization applies when program materials are sold, leased, rebroadcast, or shown to cable networks.
  • Commercial applications require prior clearances, compliance with Act 3846 and regulatory boards, and written authorization for taping/selling content.

Accreditation of Dealers and Service Centers

  • NTC will accredit dealers, suppliers, manufacturers, and service centers under MC 2-05-88 to protect the public.

Procedures for Issuance of Permits, Licenses, and Certificates

  • NC-TVRO Applicants must apply for Registration Certificate and secure a permit to purchase before registration.
  • Registration valid for 1 year, renewable up to 3 years; renew 30 days before expiration.
  • C-TVRO Applicants need permit to purchase/import before acquisition.
  • Then apply for permits to possess, construct, and operate.
  • Radio station license valid for up to 3 years; renew 60 days before expiration.

Inspection and Enforcement

  • NTC inspectors may inspect TVRO stations during reasonable hours with proper authorization.
  • Unauthorized operation subject to removal or confiscation of equipment.

Fees

  • NC-TVRO Permit to Purchase/Possess: ₱300
  • NC-TVRO Registration: ₱5,000 yearly
  • C-TVRO Application Fee: ₱300
  • C-TVRO Permit to Purchase: ₱150
  • C-TVRO Radio Station License: ₱15,000 yearly
  • Import Permit: ₱300

Grounds for Suspension, Revocation, and Penalties

  • Licenses and permits may be suspended, revoked, or amended for:
    • Willful violation of radio laws/regulations
    • False statements in applications or documents
    • Failure to operate according to license conditions
    • Other legal causes
  • Violators face fines from ₱2,500 to ₱10,000 per violation.

Implementation and Effectivity

  • The Circular is effective 15 days after publication.
  • NTC may revise or amend the Circular in the interest of public service.
