Eligibility and Award of Homelots
- An ARB may be awarded the homelot they currently occupy if it is included in the land subject to distribution under the Comprehensive Agrarian Reform Program (CARP).
- Homelots forming part of the landowner’s retained area are generally not awarded directly as homelots.
Transfer of Homelots Located in Retained Areas
- Tenant-beneficiaries with homelots within retained areas must transfer their dwelling to the farmlot awarded or other mutually agreed areas.
- Costs of transferring the dwelling and agreed improvements are borne by the landowner.
Homelots for Farmworker-Beneficiaries
- Farmworker-beneficiaries are generally required to establish their homelots within their awarded farmlots.
- If existing homelots are in retained areas, farmworker-beneficiaries must transfer dwellings at their own cost, unless the landowner opts to keep the dwelling.
- In such cases, the landowner pays the value of the dwelling and improvements for their use.
Valuation of Homelots
- The homelot value is generally computed based on the price of the farmlot awarded to the ARB.
- If the homelot lies outside the awarded farmlot but within a farmholding covered by CARP, valuation is based on the farmholding’s value.
Procedures for Acquisition and Distribution
- Procedures set forth for farmlot acquisition and distribution under Administrative Order Nos. 9 and 10, series of 1990, apply with necessary modifications.
- These procedures align with the policies governing homelot acquisition and distribution.
Effectivity and Repealing Clause
- The order becomes effective ten days after publication in two national newspapers following Section 49 of RA 6657.
- All previous orders, circulars, rules, and regulations inconsistent with this order are revoked, amended, or modified accordingly.
