Disqualified Persons from Amnesty

  • Excludes those who promoted, maintained, or led rebellion/insurrection, engaged in war, destroyed property, committed serious violence, extorted contributions, or misappropriated public funds while in public office.
  • Persons merely participating or executing commands in rebellion may still be granted amnesty.
  • Excludes persons arrested/charged with serious crimes: murder, homicide, serious physical injuries, crimes against chastity, robbery, piracy, arson, hijacking, firearms/explosives violations, and assault/resistance to authorities, unless committed as mere participants in subversion or public order crimes.

Extension of Amnesty

  • The President may extend amnesty further under conditions deemed fit to additional persons guilty of violations under RA 1700 or crimes against public order, including in furtherance of such crimes.

Conditions for Grant of Amnesty

  • Application deadline: September 30, 1978 for those under arrest or charged at the time of the decree.
  • Those not under arrest must apply within 6 months after arrest or surrender.
  • Applicants must renew oath of allegiance to the Republic and swear to support and defend the Constitution.
  • Must surrender unlicensed firearms, explosives, and ammunition.

Amnesty Commissions

  • Existing Amnesty Commissions under prior decrees or any designated bodies will process amnesty cases.

Powers and Functions of Amnesty Commissions

  • Examine facts and circumstances of each case.
  • Conduct summary hearings if needed.
  • Require official records.
  • Submit recommendations to the President through the First Amnesty Commission for review.

Pending Criminal Cases

  • Investigation and trial continue unless the President orders otherwise.

Traveling Expenses and Allowances

  • Chairperson and members of Amnesty Commissions entitled to travel expenses and daily allowance of 150 pesos.
  • Expenses charged against Command for Administration of Detainees.

Rules and Regulations

  • Existing rules under PD No. 124 (as amended) govern implementation unless inconsistent.
  • Secretaries of Justice and National Defense may jointly promulgate necessary rules for effective enforcement.

Rescission Clause

  • All inconsistent laws, decrees, instructions, rules, and regulations are rescinded or modified accordingly.

Effectivity

  • The decree takes effect immediately upon issuance on June 10, 1978.
