DAR Administrative Order No. 04, S. 2000 revises procedures for the acquisition of agricultural lands under the Comprehensive Agrarian Reform Program to expedite title issuance and ensure proper selection of Agrarian Reform Beneficiaries.

Land Survey and Screening Requirements

  • The DAR Municipal Office is responsible for screening ARBs and conducting land survey activities.
  • For properties fully covered by CARP, a boundary or perimeter sketch plan certified by a licensed geodetic engineer suffices.
  • For partially covered properties, a segregation survey plan approved by the Department of Environment and Natural Resources (DENR) must be submitted.

Processing of Landowner Claims and ARB Listings

  • Landowner claim folders must be forwarded to the Land Bank of the Philippines (LBP) for processing without the Application to Purchase and Farmers' Undertaking (APFU, CARP Form No. 4).
  • Instead of the APFU, a list of all proposed ARBs with their addresses and a certification signed by the Provincial Agrarian Reform Officer (PARO) stating that ARBs have been informed of their rights and responsibilities must accompany the claim folder.
  • The PARO ensures the number of ARBs justifies the total land area under CARP; individual farmlot awards shall not exceed 3 hectares based on the land-to-ARB ratio.

Final Screening, Compensation, and Documentation Procedures

  • Final screening and selection of ARBs must strictly comply with relevant rules and regulations.
  • The Municipal Agrarian Reform Officer (MARO) prepares the APFU before requesting LBP to pay or deposit compensation in cash and bonds to the landowner.
  • Land valuation and compensation procedures outlined in previous administrative orders remain applicable.
  • The duly executed APFU must be posted publicly for seven working days at the barangay and municipal hall where the land is located.
  • A certification of posting compliance by the MARO must be attached to the APFU.
  • The signed APFU is included in the Land Distribution Folder as reference for generating Certificates of Land Ownership Award (CLOAs) for qualified ARBs.

Application Scope

  • This administrative order applies only to land transfer claims that have not yet been transmitted to the Land Bank as of its effectivity.

Repeal and Amendment of Previous Orders

  • It amends pertinent provisions of DAR Administrative Order No. 02 (1996), DAR Administrative Order No. 01 (1998), and all inconsistent issuances.

Effectivity

  • The order takes effect ten days after its publication in two national newspapers of general circulation.
  • This complies with Section 49 of Republic Act No. 6657.
