Scope and Coverage of the Rules
- Applies to alienable and disposable lands of the public domain under specific Commonwealth and Republic Acts.
- Includes lands of the private domain covered by Act No. 3038 and real properties under DENR jurisdiction.
- Covers properties under various laws including those disposed as Friar lands, properties under Republic Act No. 477, and other specified categories.
Appraisal Procedure and Considerations
- Fair market value to be determined considering factors such as land extent, classification, location, use, assessed and zonal values, sales data, highest and best use, disposal purpose, and other relevant circumstances.
- Minimum appraisal values set: not less than assessed value for residential/agricultural/institutional lands; for commercial/industrial lands, not less than average of assessed and zonal values.
- If assessed or zonal values unavailable, comparable properties' values or current market prices are used.
- Up to 30% of industrial or commercial lands under lease used for tree growing appraised at zero value.
Composition and Creation of Appraisal Committees
- Regional Executive Director or LMB Director creates committees depending on property type.
- Committees comprise government officials such as CENR Officers, Land Investigators, Land Management Officers, representatives from the Lands Management Bureau, local assessors, and legal officers.
- Special provisions for committees handling Friar lands and properties in Baguio City under relevant laws.
- An Appraisal Committee Secretariat supports data gathering, coordination, investigation, and administrative assistance.
Appraisal Report Requirements
- Must contain findings, recommendations, and justifications.
- Should identify property details including area, classification, potential use, improvements, vicinity description, and social-economic context.
- Must attach location maps and sketch plans of improvements.
- Information from the Bureau of Internal Revenue, Assessor's Office, Register of Deeds, and other relevant sources must be included.
Mass or Carpet Appraisal
- The Committee should apply simultaneous appraisal methods for adjacent lots or subdivisions where feasible for efficiency.
Approval of Appraisal Reports
- Reports for certain types of properties approved by designated DENR officials or Lands Management Bureau Director as specified.
- Final approval authorities vary with property categories.
Validity and Effectivity of Appraisals
- Appraised values remain valid for one year from approval date for purposes of sale, lease, or permit issuance or renewal.
- For Friar Lands, validity reckoned from sales certificate issuance.
Repealing Clause
- Obsolete circulars and contradictory rules are repealed or modified to conform with this Order.
Effectivity
- Order takes effect 15 days after publication and filing of copies with the University of the Philippine Law Center.
