The Revised Rules on the Implementation of the Early Warning Device (EWD) Requirement mandates the use of EWDs for all motor vehicles, with non-compliance resulting in penalties and confiscation of driver's licenses or impounded vehicles until EWDs are presented.

EWD Not Required During Vehicle Registration

Installation Requirements for EWD

  • EWDs must be installed when the motor vehicle is stationary for any reason.
  • They must be placed at least four (4) meters to the front and to the rear of the vehicle.
  • Required especially if the vehicle stops where standing or parking is prohibited.

Specifications of the Early Warning Device

  • Shape and material: Each EWD must be a triangular, collapsible reflectorized plate.
  • Size: Each side of the triangle must be at least 40 centimeters long and 5 centimeters wide.
  • Visibility: Must be visible at a distance of at least 400 meters under high beam and adverse weather conditions.
  • Positioning: EWDs must lean slightly backward, from 5 to 10 degrees from the perpendicular axis to the roadway to maximize visibility.

Penalties for Non-Compliance

  • Fine of Php 500 for operating a vehicle without carrying EWDs.
  • If charged with other violations along with non-carrying of EWD:
    • Mandatory payment of the fine.
    • Driver’s license will remain confiscated until EWDs are presented at case adjudication.
  • If vehicle impounded with failure to carry EWDs among violations:
    • Release of the vehicle is withheld until EWDs are presented to the adjudicating officer.

Repealing Clause

  • All prior memoranda, circulars, or issuances that conflict with this memorandum circular are superseded.
  • The memorandum circular shall serve as the new guideline and must be strictly observed and complied with by all concerned.
