Scope and Coverage

  • Applies to all non-commercial inbound consolidated shipments sent by OFWs.

  • Implemented under the authority of Section 105(f) of the Tariff and Customs Code of the Philippines (TCCP), as amended.

Customs Inspection and Procedures

  • Balikbayan boxes shall not be subjected to random or arbitrary physical inspection.
  • Mandatory X-ray scanning is required for all balikbayan boxes at the designated X-ray Inspection Project (XIP) Designated Examination Area (DEA).
  • Non-commercial inbound consolidated shipments flagged as suspect after X-ray screening will be further evaluated by an XIP image analysis inspector.
  • Boxes without identified violations are separated and provisionally released to facilitate continued processing.

Handling of Alerted Balikbayan Boxes

  • Boxes identified with potential violations (Alerted) must undergo 100% physical examination in authorized examination areas.
  • A Customs Examiner will conduct the physical examination in the presence of other key stakeholders including apprehending officers, the freight forwarder consolidator, representatives from Overseas Workers Welfare Administration (OWWA), and/or designated OFW Association officers.
  • 100% physical examination may be allowed at freight forwarder/consolidator warehouses to facilitate trade and alleviate port congestion, contingent upon submission of an Affidavit of Undertaking and compliance with existing customs regulations.

Enhancement of Inspection Capabilities

  • Bureau of Customs (BOC) intends to acquire K-9 units to aid in detection efforts.
  • Installation of Closed-Circuit Television (CCTV) systems in all authorized inspection/examination areas to ensure transparency and security.

Accountability and Penalties for Customs Personnel

  • Non-compliance by customs officials or personnel with any directives under this order will be subject to penalties under Section 3604 of the TCCP, as amended.
  • Further disciplinary actions may be pursued under applicable civil service rules and regulations.

Information Dissemination and Public Awareness

  • BOC is authorized to produce and distribute informational materials such as notices, leaflets, and other communications.
  • Aim is to educate OFWs about the simplified customs procedures under this Order to promote awareness and compliance.

Repealing Clause

  • All prior orders, circulars, memoranda, or issuances conflicting with this Order are modified or repealed as necessary to give full effect to this regulation.

Effectivity

  • The Order takes effect immediately upon filing and adopts all provisions without delay to benefit OFWs and enhance customs operations.
